Croquignole conquers the salon
The flat winding that Josef Mayer presented in 1924 did not stay a Central-European specialism for long. Within a decade the croquignole method — wound from the ends toward the scalp, heated in packets on rods lying flat — had crossed the Atlantic and spread outward across the trade. Manufacturers built machines around it; schools taught it; congresses and competitions ratified it; and in the United States the patents that fenced it in reached the federal courts. The permanent wave, an inventor's contrivance in 1906, had become by the mid-1930s an industry. This chapter is about that passage — from a method to a trade — and about the gaps the surviving record leaves in it.
The previous chapter followed the croquignole onto a single head: the flat section, the scalp-protector clip, the sealed sachet, the sleeve heater, the roughly ninety-minute treatment that made the wave safe for the bob. This one follows it out of the salon and into the world. The two stories cannot be cleanly separated, because the system's commercial success and its technical design were the same fact: a method that was modular and teachable was also one that could be licensed, manufactured, exported, and — eventually — litigated over. What the croquignole conquered was not a single head of hair but the apparatus of an entire trade.
A note on the evidence before it begins. The inter-war salon's social and commercial history is patchily documented in the open record. The technical record — the patents and the federal cases — is firm; the biographical record of the manufacturers, schoolmasters, and competitors is thin. Where a fact rests on a court opinion or a patent it is stated plainly; where the record is secondary, inferential, or silent, it is caveated rather than asserted. The honest gaps are part of the history.
A method becomes a trade
The croquignole's route outward from Central Europe followed the channels any technique of that era used: the trade press, the travelling specialist, and the licence. Mayer had built his system in the spa town of Karlsbad (Karlovy Vary), a resort whose wealthy, international clientele made it a natural distribution point for a cosmetic specialism. The 1924 presentation at the federal congress of hair-shapers in Dresden put the flat winding before the organised trade; from there it moved, within months, into the established salon capitals of the continent — Paris, London, Vienna, Berlin — through the same network of masters and journeymen who attended the congresses and read the trade papers.
The method's export to the United States is better documented than its European spread, because the American record is built on patent filings and company registrations rather than on trade journalism. The Cincinnati Realistic Permanent Wave Machine Company was founded by Philip D. Spaeth in 1925 — not by Mayer, whose relation to the American trade was that of a licensor. Spaeth's company became the American manufacturing and licensing vehicle for the croquignole system, and it was through entities of this kind — manufacturer-licensees holding the apparatus patents and granting method licences downstream — that the croquignole reached the American salon chair. The croquignole crosses the Atlantic. Spaeth founds the Cincinnati Realistic Permanent Wave Machine Company; the apparatus patents are held in the United States and the method is licensed to manufacturers and, downstream, to individual salons. The flat winding, a Central-European system a year earlier, is now an American trade.
What made the croquignole amenable to this kind of industrialisation was its modularity. Nessler's spiral machine of 1906 had been, in commercial terms, a bespoke apparatus operated by a specialist; the croquignole, by contrast, came as a kit of parts — rods, scalp-protector clips, sachet materials, sleeve heaters, the electric control — each of which could be manufactured, priced, and replaced independently. The kit invited the manufacturer; the standardised process invited the licensee; and the speed of the treatment (roughly ninety minutes against the spiral's hours) invited the volume of business that made licensing worth the paperwork. A method that could be performed identically in two thousand salons could also be sold identically to two thousand salons.
The schools and the craft
The croquignole also created a new specialism within the hairdressing trade: the permanent-wave operator, trained and certified in a distinct technique rather than apprenticed into general salon practice. The systematised winding — flat section, controlled tension, sealed sachet, timed heating — was teachable in a way the older hot-wave methods, dependent on the individual specialist's judgement, had only imperfectly been. Schools sprang up to teach it. Mayer's own Karlsbad school ran night-time courses for masters and journeymen, and the agency network he built from the 1927 founding of the Mayer Realistic Karlsbad company carried the same curriculum outward through its offices in New York, Melbourne, London, Paris, Vienna, and Berlin.
The figure attached to that network in the memorial record is twenty-two countries — the reach of what the sources describe as the "Association of the Mayer-Realistic Permanent-Wave Operators." Twenty-two is the kind of round number the trade literature of the period liked, and it should be read as an order-of-magnitude claim about an international operator network rather than as an audited census. What is not in doubt is the structural fact behind it: the croquignole was the first permanent-wave method to be disseminated through a formal training-and-certification apparatus at international scale. The Marcel wave had been taught and named half a century earlier; the croquignole was the first to be certificated across continents.
The school did more than train operators: it standardised the technique. A winding taught the same way everywhere could be owned, licensed, and — when the question arose — described in a patent and litigated as one method. The school and the patent were two faces of the same artefact. The standardisation that made the croquignole teachable also made it enforceable.
The croquignole did not merely travel; it was carried — by licensees, by schoolmasters, by a curriculum. A method taught the same way in twenty-two countries could be sold the same way in twenty-two countries, and sued over the same way in any one of them.
Competitions and congresses
The third channel of diffusion was prestige. The inter-war hairdressing trade ran on congresses, exhibitions, and competitions — public occasions at which a method's quality was demonstrated before judges and rivals, and at which medals and diplomas ratified a school's standing. Mayer had come up through exactly this culture: his pre-war training had taken him through Budapest, Vienna, Milan, Nice (a Médaille d'Or in 1903) and Paris, and he had understood from the first that a technique's reputation was made in public and then monetised in the salon. The croquignole followed the same path. International competitions became the method's prestige engine — the forum at which a Karlsbad-trained operator's work was measured against a London or New York rival's, and at which the system's claims to softness, root-wave, and speed were demonstrated rather than merely advertised.
The competition culture of the inter-war salon is well attested in the general record of European hairdressing, but the specific congress records — the dates, the named judges, the lists of medallists — are not consistently preserved in open archives. What survives is the pattern: a method's authority was built cumulatively, in public, across a calendar of congresses that ran alongside the trade's commercial calendar. The croquignole's dominance of that calendar in the late 1920s and early 1930s is the social mechanism by which it became, in the trade's own estimation, the standard winding.
International competitions and trade congresses become the croquignole's prestige engine — the public forum in which the system's claims to softness, root-wave, and ninety-minute speed are demonstrated before the trade. The specific congress records are patchily preserved; the pattern of the croquignole's dominance of the calendar is clear.
The world takes it up
The croquignole's geographic spread is the part of this history that the open record documents least well, and it is worth being plain about that. The documented sequence is firm at its endpoints: Karlsbad in 1924, the American landing in 1925, and by the early 1930s a Mayer agency network that the memorial names across New York, Melbourne, London, Paris, Vienna, and Berlin. Beyond those anchors, the picture becomes inferential. That the flat winding reached South America, that it travelled to East Asia through the European salon trade, that it displaced the spiral in markets where the bob had also arrived — all of this is consistent with the method's economics and with the general pattern of inter-war cosmetic-fashion diffusion, but the trade-by-trade documentation is thin, and this chapter does not assert specifics it cannot source.
What can be said with confidence is structural. The croquignole spread along the same routes the bob had spread along, because the two were, commercially, a matched pair: a hairstyle that demanded a wave, and a method that could wave it. Where the bob went — and by the late 1920s the bob had gone everywhere that urban fashion went — the croquignole followed, because no other method on the market could serve it. The spiral machine was by then a technique without a clientele in the fashionable cities; the cold wave, which would eventually supersede the croquignole on chemistry rather than geometry, was still in the laboratory in the early 1930s. For roughly a decade, the flat winding was the answer the world's salons had to the hair the world's women were wearing.
The honest framing is one of well- and under-documented layers. The patent record is firm; the U.S. manufacturer-licensee ecosystem is documented through the litigation that followed it; the European salon-capitals and the Mayer agency network are documented through the memorial; and the further geographic reach is stated here as a reasonable inference from the method's economics and the bob's diffusion, not as a documented fact. The croquignole's global conquest is real; its precise itinerary, in many places, is not recoverable from the open record.
The patent wars reach court
The same standardisation that carried the croquignole across the world also carried it, inevitably, into the courts. A method practised in thousands of salons, held under licence, and enforced by an American assignee was a method with a great deal of money attached to its exclusive use — and a method whose exclusivity the unlicensed trade had every incentive to challenge. The litigation that resulted is the best-documented part of this chapter, because it left federal opinions behind it.
The American campaign, pressed through the Philad Company as assignee, ran from the early 1930s into the 1940s and reached the trade at two levels at once: the manufacturers who built croquignole machines, and the individual salons that used them. The figures the campaign generated, as they reached the federal record, are documented in two anchor points. The 1932 Sixth Circuit opinion in Naivette, Inc. v. Bishinger (61 F.2d 433) described a trade holding more than three thousand croquignole machines, with sums on the order of a million dollars at stake. By 1940, in National Hairdressers' and Cosmetologists' Association v. the Philad Company (34 F. Supp. 264), the campaign reached roughly five thousand salons, across some fifty-seven cases, with annual licence revenue on the order of twelve dollars per salon per year and aggregate receipts around sixty thousand dollars a year. Both are the campaign's figures — describing the enforcement, not the whole market — and both are attributed to the court records rather than asserted from the trade.
The decisive finding was the 1932 court's refusal, in Naivette, to credit Mayer as "the father of the Croquignole wave." The croquignole wrap, the court found, had antecedents in the trade; Mayer had contributed the integrated system, not the bare winding. That finding — that the winding itself was common property — became the foundation on which the 1940 class action held the reissue method patent RE 18,841 invalid, and on which the Third Circuit affirmed that holding in 1942. With the principal method patent gone, the architecture of the estate fell, and the croquignole passed into common use. The irony is structural: the method conquered the world's salons in the very years its patents were being dismantled in the American courts.
